§ 1 Scope
These Terms of Service govern the use of ClaimEU261 (claimeu261.com), operated by Felix Franz Schulte, Ringstraße 49, 59590 Geseke, Germany. ClaimEU261 generates automated complaint letter templates for air passengers based on EU Regulation 261/2004. The one-time fee is 9.99 EUR (gross price incl. VAT, varies by country).
§ 2 No Legal Advice
The generated complaint letters do not constitute legal advice. ClaimEU261 is not a law firm and does not provide legal services. The letters are templates or drafts that the user must review and, if necessary, amend before use. For complex cases, we recommend consulting a lawyer or using a dispute resolution body.
§ 3 No Guarantee of Success
ClaimEU261 makes no warranty regarding the accuracy, completeness, or success of the generated complaint letters. Whether the airline grants the complaint and pays compensation is solely at their discretion and depends on the applicable legal situation.
§ 4 Use of AI
Parts of the complaint letter may be created or refined using artificial intelligence. AI-generated content is transparently labelled in accordance with EU AI Act Art. 50. The user is responsible for reviewing AI-generated content before use.
§ 5 Payment and Withdrawal
Payment is made once through our payment processor Digistore24 GmbH (Reseller/Merchant of Record, St.-Godehard-Straße 32, 31139 Hildesheim, Germany). The displayed price is a gross price including the applicable VAT. You have a 60-day money-back guarantee. Within 60 days of purchase, you can request a full refund without giving any reason. § 6 Limitation of Liability
ClaimEU261's liability is limited to the purchase price. This does not apply to damages arising from injury to life, body, or health, or to damages caused intentionally or through gross negligence. Further liability claims are excluded to the extent permitted by law.
§ 7 Applicable Law
German law applies. Mandatory consumer protection provisions of the country in which the user has their habitual residence remain unaffected.
§ 8 Changes
ClaimEU261 reserves the right to amend these Terms of Service. The version in effect at the time of purchase shall apply.
